Purpose
This policy explains how Example Provider Pty Ltd identifies, declares and manages conflicts of interest. Its goal is simple: to make sure every decision we make puts the participant first and protects their right to make their own choices about the supports and providers they use.
Managing conflicts well is part of working honestly and acting with integrity under the NDIS Code of Conduct, and it is expected by the NDIS Practice Standards - particularly where we deliver support coordination or plan management.
What a conflict of interest is
A conflict of interest happens when a personal, financial or other interest could influence - or could look like it influences - the way we support a participant or the advice we give them. A conflict can be:
- Actual - a real conflict exists right now.
- Potential - a conflict could arise in the future.
- Perceived - a reasonable person might think our judgement could be affected, even if it is not.
A conflict does not always mean someone has done something wrong. What matters is that we recognise it early, are open about it, and manage it so the participant is not disadvantaged.
Common examples in disability support
- A support coordinator or plan manager referring a participant to Example Provider Pty Ltd’s own services, or to a related business, without offering genuine alternatives.
- Recommending a product, service or another provider because of a referral fee, commission, kickback or other benefit to us.
- Offering or accepting gifts, money, hospitality or favours that could influence a decision.
- A dual relationship - for example supporting a participant who is also a friend, family member, neighbour or business associate of a worker.
- A worker having a financial interest in another organisation that we deal with on the participant’s behalf.
- Steering a participant toward choices that benefit Example Provider Pty Ltd rather than what best meets the participant’s needs and goals.
Support coordination and plan management conflicts
A particular conflict arises where Example Provider Pty Ltd provides support coordination or plan management AND also delivers (or is linked to) other supports the participant could buy. This is one of the most closely watched conflicts in the NDIS, because the participant relies on us for independent help to choose providers. Where this applies, Example Provider Pty Ltd will:
