Terms of Service

The short version
- Bluetail sells a $50 one-off NDIS Registration Pack - pre-filled documents that prepare you for NDIS Commission registration. We do not register you with the Commission.
- Preview every document free; pay $50 once when you're ready to download the editable Word files.
- All sales are final. Because you receive immediate digital delivery, we do not offer refunds.
- The documents are templates. You are responsible for reviewing, customising and using them appropriately - especially the high-risk policies (medication, mealtime, restrictive practices).
- Nothing here removes any non-excludable rights you have under the Australian Consumer Law.
1. Acceptance
By creating an account or using bluetail.com.au (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Bluetail Pty Ltd ("Bluetail", "we", "us").
2. What we sell
Bluetail's primary product is the NDIS Provider Registration Pack: a set of pre-filled policies, agreements, contracts and forms generated from our templates and your business details (business name, ABN, contact details, logo). The pack is sold as a one-off purchase of $50 AUD. On purchase, you receive the right to download, edit and use the generated documents as your own business's documents indefinitely.
We may also offer additional Bluetail products (for example, tools for Support Coordinators). Use of those products is subject to these Terms together with any product-specific terms surfaced inside the product.
3. What the Pack is - and is not
- The Pack prepares you for registration. It does not register you. Becoming a registered NDIS provider requires you to obtain insurances, complete worker screening, complete the NDIS Worker Orientation Module, set up a PRODA account, submit an application to the NDIS Quality and Safeguards Commission, and pass an audit by an approved quality auditor. We tell you, in plain language, what those steps are. We do not perform them for you.
- The documents are templates. They are written to reflect current NDIS Rules, Practice Standards and the NDIS Code of Conduct as we understand them, and are pre-filled with the business details you enter. They are not legal advice, clinical advice, or a guarantee of compliance.
- You must review each document before you rely on it - and adjust it to reflect how you actually operate. We flag the highest-risk policies (medication, mealtime, restrictive practices) and recommend you have a clinically qualified person review them. That recommendation is part of the Pack and is not a substitute for your own due diligence.
- Bluetail is not your NDIS auditor, your clinician, your lawyer or your accountant.
4. Account and your information
- You must be at least 18 years old and have authority to enter into these Terms on behalf of your business.
- You are responsible for keeping your login credentials confidential and for activity that occurs under your account.
- The business details you enter must be accurate and yours to use. You must not impersonate another business or use someone else's ABN.
- You can ask us to delete your account and data at any time via info@bluetail.com.au; see the Privacy Policy for the detail.
5. Payment and refunds
- Payment is processed by Stripe. We do not see or store your card details.
- The Pack price is $50 AUD as a one-off charge. We may change the price for future purchases; the price you see at checkout is the price you pay.
- All sales are final. The Pack is a digital good with immediate delivery - every document is previewable in full for free before you pay, and the documents you receive on unlock are downloadable immediately. We do not offer refunds, exchanges or credits once payment has been made. You acknowledge this by choosing to pay.
- This does not affect any rights you have under the Australian Consumer Law that cannot be excluded - see section 10.
6. Free updates
We aim to keep the templates aligned with current NDIS Rules, Practice Standards and Code of Conduct. When we update a template, you can sign back in and re-download the latest version of any document at no additional cost. The free-updates promise is provided in good faith; we may discontinue or change it on reasonable notice (the documents you have already downloaded remain yours).
7. Your responsibilities
- Review every document before use. Customise it to your business, your participants, your jurisdiction and the way you actually deliver supports.
- Get appropriate professional review of the high-risk policies (medication, mealtime, restrictive practices) before relying on them in real practice. Our in-product recommendations identify these.
- Maintain your own insurances, screening and registrations as required to operate as an NDIS provider.
- Follow the NDIS Code of Conduct and applicable law at all times.
- Do not use the Service for any unlawful purpose, to harass others, or to attempt to interfere with our infrastructure or other users' accounts.
8. Ownership and licence
The Bluetail templates, software, brand and marketing materials remain Bluetail's intellectual property. When you generate a document from a template, the document you generate is yours to keep, edit, sign and use indefinitely within your own business. You may not resell, sublicense or redistribute Bluetail templates or generated documents to any third party as a template product or substitute service.
9. Limitation of liability
To the maximum extent permitted by law, Bluetail is not liable for any loss or damagearising from your use of the Service or the documents, including without limitation: failure of an NDIS registration application or audit; any NDIS Commission enforcement action; loss of revenue, profits, goodwill, or business opportunity; harm to a participant or worker; any indirect, incidental, consequential, special or punitive damages; or any third-party claim.
You acknowledge that the documents are templates, that real-world use depends entirely on how you customise and operate them, and that you bear sole responsibility for the appropriateness, accuracy and use of every document you download. Where any liability of Bluetail cannot be excluded but can be limited, our total aggregate liability to you in any 12-month period is limited to the amount you paid Bluetail in that period (typically $50).
10. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded or limited. To the extent any consumer guarantee under the Australian Consumer Law applies and cannot be excluded, our liability for failure to comply with that guarantee is limited (at our option) to re-supplying the relevant Service or refunding the price paid for it.
11. Suspension and termination
You can stop using the Service at any time. We may suspend or terminate your account if you materially breach these Terms (for example, by sharing the templates as a competing product, by misrepresenting your identity, or by attempting to abuse the Service or other users). On termination, documents you have already downloaded remain yours; access to future updates may be removed.
12. Changes to these Terms
We may update these Terms from time to time. The current version will always be available at bluetail.com.au/terms. Material changes will be flagged the next time you sign in. Continued use of the Service after a change constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales.
